To participate in the Curate Your Legacy Promotion ("Game" or "Promotion"), you (if a Minor [as defined below], your parent/legal guardian) must agree to and abide by these Official Rules ("Official Rules").

FOR RESIDENTS OF THE UNITED STATES AND CANADA: 

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

FOR RESIDENTS OF MEXICO, AUSTRALIA, UNITED KINGDOM, FRANCE, GERMANY AND SOUTH AFRICA:

THE PURCHASE OF A SPECIALLY MARKED PRIME HYDRATION DRINK AT THE REGULAR RETAIL PRICE IS REQUIRED.

ENTRANTS UNDER THE AGE OF MAJORITY IN THEIR LEGAL JURISDICTION OF PRIMARY RESIDENCE ("MINOR") MUST HAVE PERMISSION FROM THEIR PARENT OR LEGAL GUARDIAN IN ORDER TO ENTER. 1. Sponsor: Prime Hydration, LLC, 2858 Frankfort Ave, Louisville, KY 40206 U.S.A., Prime Hydration UK Limited, 60 Gracechurch Street, 6th Floor, London, EC3V 0HR U.K., and Congo Brands Australia Pty Ltd., Blue Rock Australia, Level 16, 414 Latrobe Street, Melbourne, VIC 3000 AUS (ABN: 85664214733) (collectively, "Sponsor").

2. Administrator: Probability LLC ("Probability"), 2 Woodstock Meadows Ln, PO Box 1484, Woodstock, NY 12498 U.S.A. ("Administrator") 

3. Eligibility: The Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia, Canada, Mexico, Australia, the United Kingdom, Metropolitan France, Germany and South Africa (collectively, "Territory"), who are at least sixteen (16) years of age. Any employees, consultants, independent contractors, and interns who have, within the past six months, performed services for Sponsor, Administrator,  entities involved in any way with the production or distribution of bottles of specially marked Prime Hydration product, and/or participating retail stores selling specially marked Prime Hydration product (collectively, "Promotion Entities") and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to participate or win the prize. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. Void in Puerto Rico, other United States Territories, Overseas Territories of France (also known as "Dom-Tom"), outside Territory and where prohibited or restricted by law. All federal, state, provincial, and local laws and regulations apply.

4. Game Schedule: The Promotion begins at 12:01:00 a.m. United States Eastern Time ("ET") (e.g. New York time) on June 2, 2025 and ends the earlier of: (i) 11:59 p.m. ET on July 13, 2025; or (ii) when all 12-character alphanumeric codes (each a "Code", collectively "Codes") have been distributed, subject to the prize claim deadline set forth below in Rule 5c (collectively, "Promotion Period"). ET corresponds to Coordinated Universal Time (UTC) minus four (4) hours. For example, where the stated time is 12:00 a.m. ET, this time corresponds to 4:00 a.m. UTC of the same day, and where the stated time is 11:59 p.m. ET, this corresponds to 3:59 a.m. UTC in the morning of the following day.  IMPORTANT NOTICE TO PARTICIPANTS: ALL TIMES LISTED THROUGHOUT THE REMAINDER OF THE OFFICIAL RULES ARE IN UNITED STATES EASTERN TIME. PARTICIPANTS ARE SOLELY RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS. The computer of Sponsor’s third party technology partner is the official clock for the Promotion.*

*For German residents, Promotion Period starts at 6:01:00 a.m. Central European Summer Time ("CEST") on June 2, 2025 and ends the earlier of (i) 5:59 a.m. CEST on July 14, 2025 or (ii) when all Codes have been distributed, subject to the prize claim deadline set forth below in Rule 5c. For residents of South Australia, Promotion Period starts at 1:31:00 p.m. Australian Central Standard Time ("ACST") on June 2, 2025 and ends the earlier of (i) 1:29 p.m. ACST on July 14, 2025 or (ii) when all Codes have been distributed, subject to the prize claim deadline set forth below in Rule 5c.  

5. How to Play: During the Promotion Period, eligible individuals may participate as follows: 

a. Step 1: Obtain a Code:

i. VIA PURCHASE: Purchase a bottle of Sponsor’s specially marked Collector Series limited edition Prime Hydration drink at any participating local retail store in the Territory.

ii. FOR THE UNITED STATES AND CANADA ONLY: NO PURCHASE NECESSARY – FREE CODE: To obtain a Code without making a purchase, send a self-addressed stamped envelope (except residents of Vermont and Canada) and mail to: “Prime Curate Your Legacy Promotion, c/o Probability LLC, P.O. Box 1559, Social Circle, GA 30025. Mail-in requests must be postmarked by July 14, 2025 and received by July 21, 2025 to be eligible. For the avoidance of doubt, those who submit a valid request for a Code by mail will receive a piece of paper containing a Code only; they will NOT receive a bottle of Prime Hydration, bottle cap or bottle label. Each request must be submitted in a separate mailing envelope. One (1) randomly selected Code per valid request. Sponsor and Administrator are not responsible for postage due mail.

b. Step 2: Navigate the internet to CollectorSeries.DrinkPrime.com (the "Website") to create your free Prime Promotion account ("Prime Account"). Click on the "Create an Account" link and provide the requested information via the registration form including your first name, last name, phone number (optional), email address and country of residence. You will be asked to create a password to access your Prime Account for Game play. Be sure to maintain the security of your password. If you already have a Prime Account, simply access your account. For the avoidance of doubt, if you participated in the Sponsor's PRIME X PROMOTION in 2024, you must create a new Prime Account to participate in this Promotion. Limit: One (1) Prime Account per Entrant.

c. Step 3: Once your Prime Account has been created, navigate to the Game portion of the Website. No later than August 1, 2025 at 11:59 p.m. ET/August 2, 2025 at 5:59 a.m. CEST/August 2, 2025 at 1:29 p.m. ACST ("Prize Claim Date", in Germany, the "Closing Date"), follow the on-screen prompts to input each Code that you have collected. Depending on the type of Code collected, inputting the Code will automatically "unlock" a digital trophy from the digital Collector Series trophy collection ("Trophy"). (For clarity, no prize will be awarded in conjunction with a participant unlocking a Trophy.) There are ten (10) different types of Codes, including one (1) rare code, each of which "unlocks" a different Trophy. If you collect and input all ten (10) different types of Codes, including one (1) rare code, the entire Trophy collection ("Collection") will be complete, and you will receive a CONGRATULATIONS message stating that you have won the Prize (or a portion thereof), subject to verification. See "Verification" below as well as Rule 7 below.

(If the same type of Code/Trophy is collected multiple times, a "You already unlocked this Trophy." message will be displayed after the first time that Code/Trophy has been collected.) Each Code can only be recorded once in the Prime Account of the person that obtained it. IMPORTANT: Make sure bottle caps (or, for the United States and Canada, pieces of paper bearing Codes) are kept safe and undamaged at all times. You may be required to send winning caps with the Codes and/or the pieces of paper containing the free Code(s) to the Administrator as part of the prize claim process as discussed below.

IN ORDER TO CREATE A PRIME ACCOUNT AND PARTICIPATE IN THE PROMOTION, ENTRANT MUST CLICK THE CHECK BOXES SIGNIFYING THAT ENTRANT MEETS THE ELIGIBILITY REQUIREMENTS AND HAS READ AND AGREED TO THESE OFFICIAL RULES, AS WELL AS SPONSOR'S TERMS OF USE (AVAILABLE AT https://drinkprime.com/pages/terms-of-use [AUS, CAN & US]; https://drinkprime.uk/pages/terms-of-use [UK, DE, FR AND SA]), AND PRIVACY POLICY (AVAILABLE AT https://drinkprime.com/pages/privacy-policy [AUS, CAN, MX AND US]; https://drinkprime.uk/pages/privacy-policy [UK, DE, FR AND SA]). IF ENTRANT DOES NOT CHECK THE BOX INDICATING CONFIRMATION OF AND AGREEMENT TO THE ABOVE, ENTRANT WILL NOT BE ABLE TO INPUT ANY CODES COLLECTED/UNLOCK ANY TROPHIES AND THEREFORE CANNOT WIN THE PRIZE. (IF ENTRANT IS A MINOR, THEIR PARENT OR LEGAL GUARDIAN SHOULD READ AND AGREE TO THESE OFFICIAL RULES, TERMS OF USE, AND PRIVACY POLICY ON SAID MINOR’S BEHALF.)

You may be asked to consent to receive promotional e-mails and reminder e-mails from Sponsor. Consenting to receive promotional e-mails and reminder e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Promotion and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of your data shall be subject to the privacy policy of the Sponsor (Sponsor’s Privacy Policy, available at (https://drinkprime.com/pages/privacy-policy [AUS, CAN, MX AND US]; https://drinkprime.uk/pages/privacy-policy [UK, DE, FR AND SA]) and you may opt out of receiving these e-mails at any time.

Online submission of Code(s) referred to herein collectively as "Entry" or "Entries."

Limit five thousand (5,000) Entries per Entrant during the Promotion Period. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all Entries by such person. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. All Entries must be received during the Promotion Period. Any attempt by an individual to participate by using multiple/different email addresses, mailing addresses, identities, registrations and logins, or any other methods may result in such Entrant being disqualified from participating in the Promotion. Normal Internet access and usage charges imposed by your online service may apply; the preceding includes wireless carrier charges.

Entries that are not in accordance with these Official Rules as stated herein or are not received during the Promotion Period will be ineligible.

Verification: All Codes are subject to verification. Such verification process may include the request for submission of the physical bottle caps^ bearing the Codes from specially marked Collector Series limited edition Prime Hydration bottle (or, for Canada and the United States, the piece[s] of paper bearing Code[s]) ("Verification"). If an Entrant fails to comply with such request or if Sponsor/Administrator determine that any submitted bottle cap (or, for Canada and the United States, the pieces of paper bearing the Code) does not adequately establish the validity of such Entrant's prize claim, such Entrant will, subject to any directions by a regulatory authority, be disqualified, and the prize forfeited without liability of any kind to Sponsor or Administrator.

To the fullest extent permitted by law, bottle caps/Codes are void and will be rejected if they contain printing, typographical, mechanical or other errors or are otherwise printed/produced in error. Bottle caps/Codes are also void (and will be rejected) if not obtained through authorized, legitimate channels (for Mexico, Australia, the United Kingdom, France, Germany and South Africa, ONLY via purchase of specially marked Collector Series limited edition Prime Hydration bottles; for Canada and the United States, via purchase of specially marked Collector Series limited edition Prime Hydration bottles or valid mail-in request), or if any part is defective, illegible, altered, duplicated, photocopied, reproduced, forged, counterfeited, defaced, mutilated or tampered with in any way or, to the fullest extent permitted by law, if they contain or are the result of printing, digital, electronic, typographical, mechanical or other error. Once all ten (10) Codes (including the one [1] rare Code) of an Entrant are verified, that Entrant is a potential winner ("Potential Winner"), provided all their Codes were obtained and entered in accordance with these Official Rules. If after Verification there is more than one (1) Potential Winner due to a programming, technological, printing error, failure or malfunction of any kind, only one (1) Prize will be awarded via random drawing to take place at Administrator's offices located at 2 Woodstock Meadows Ln, Woodstock, NY 12498 U.S.A. on August 6, 2025 at 11:30 a.m. ET/August 6, 2025 at 5:30 p.m. CEST/August 7, 2025 at 1:00 a.m. ACST from among valid/verified Prize claims received (provided that the Prize has not already been awarded.)

Should Sponsor or Administrator determine that an attempted act of fraud has taken place, Sponsor and/or Administrator reserve the right to prosecute such action to the fullest extent permitted by law (in addition to disqualification of entrant and prize forfeiture without liability of any kind).  To the fullest extent permitted by law, the sole responsibility of Sponsor and Administrator for any irregular or defective Code is replacement with another randomly selected Code, provided supplies last; and, if supplies have been exhausted, neither Sponsor nor Administrator shall have any liability whatsoever. All Codes must be submitted and recorded by the computer of Sponsor’s third party technology partner by Prize Claim Date (for Germany, Closing Date) and Codes entered after such time are void and of no legal effect. Each Code may only be submitted once and may only unlock a maximum of one (1) Trophy. Codes submitted in any manner other than as stated in these Official Rules are void and will not be honored or returned. The sale (via auction or otherwise), trading, transfer, assignment, combining or barter of any Code, bottle (including bottle cap), or other Game materials is prohibited. Codes (as well as Trophies) have no cash value, and may not be purchased or redeemed for cash or credit. Codes (as well as Trophies) may only be used in a manner consistent with, and as stated in, these Official Rules; any other use (or attempted use) of Codes/Trophies constitutes fraud. If 

^Where required by law, Sponsor will defray the cost of submission of the physical bottle cap bearing Code and/or will provide an alternative method in lieu of submission of the physical bottle cap bearing Code.

6. Prize, Approximate Retail Value ("ARV") and Odds: One (1) prize will be offered. 

PRIZE: $1,000,000 (one million) U.S. Dollars ("USD") ("Prize") paid to the winner (if a Minor, their parent or legal guardian, who will be deemed the winner) by bank transfer, without any right to interest and in winner's local currency.** In no event will more than $1,000,000 (one million) USD be awarded as the prize in the Game.

In the event more than one (1) Entrant completes the Collection (i.e., collects all ten [10] different types of Codes, including one [1] rare code, and unlocks all ten [10] different Trophies), and is a Winner as defined in Rule 5c above, the Prize will be divided equally among all Winners who comply with the Prize Claim Procedure laid out in Rule 7 below and have been verified as being eligible and in full compliance with these Official Rules.

**Based on currency exchange rates on April 9, 2025, the Prize has the following values in local currency: $1,410,061.15 (CAD); $20,292,456.22 (MXN); $1,623,124.68 (AUS); £780,003.32 (GBP); €912,411.56 (EUR); R19,256,665.29 (ZAR).

It is the winner’s sole responsibility to make the necessary arrangements to facilitate payment into a suitable licensed bank account with a registered financial institution in their country of residence. The Sponsor’s offer to pay by bank transfer shall not prevent the Sponsor/Administrator from opting to make the payment by personal check or bankers’ check if the Sponsor/Administrator determines that this is necessary or preferable in its sole discretion for any reason (which need not be disclosed). To the fullest extent permitted by law, the winner (if a Minor, their parent or legal guardian, who will be deemed the winner) agrees that payment of the prize by bank transfer shall be at the winner’s risk and that if the transfer is not received in the winner’s designated account due to bank error or any other reason that is not directly and solely due to the Sponsor/Administrator then the Sponsor/Administrator shall not be liable under any legal theory.

Prize is not transferable by Winner(s). No prize substitutions are allowed. Any and all expenses in conjunction with prize acceptance and use are the sole responsibility of Winner(s); the preceding includes all costs involved in establishing a licensed bank account with a registered financial institution.

EXCEPT AS OTHERWISE PROVIDED BY APPLICABLE LAW, WINNER(S) (IF A MINOR, THEIR PARENT/LEGAL GUARDIAN) WILL BE SOLELY RESPONSIBLE FOR ANY AND ALL TAXES ON THE VALUE OF THE PRIZE. IF WINNER IS A U.S. RESIDENT, THEY WILL BE ISSUED AN IRS FORM 1099 FOR TAX PURPOSES IN THE AMOUNT OF THE PRIZE AND MUST SUBMIT THEIR SOCIAL SECURITY NUMBER OR TAX IDENTIFICATION NUMBER VIA IRS FORM W-9, AS REQUIRED BY LAW. NON-U.S. RESIDENT WHO WINS PRIZE MAY BE REQUIRED TO COMPLETE U.S./IRS TAX FORMS IN ACCORDANCE WITH APPLICABLE U.S. LAW. (THE PRECEDING IS IN ADDITION TO ANY TAX REPORTING OR PAYMENT OBLIGATIONS OF WINNER[S] IN THEIR COUNTRY OF RESIDENCE.) A NON-U.S. RESIDENT WHO WINS PRIZE MAY ALSO BE SUBJECT TO U.S. FOREIGN WITHHOLDING TAX.

7. Prize Claim Procedure: Subject to the Second Chance Drawing as discussed in Rule 8, below, Potential Prize Winner(s) [the number of such Potential Prize Winner(s) will depend on the number of eligible individuals who input and collect all ten (10) different types of Codes (including one [1] rare Code) and unlock all ten (10) different Trophies, as discussed in Rule 5c above] will be contacted by Administrator via the email associated with their Prime Account as per Rule 5b, above, within three (3) business days of the Prize Claim Date (for Germany, Closing Date), and will be required to sign and return, to the fullest extent permitted by law, an Affidavit of Eligibility & Liability Release and where legal, a Publicity Release (collectively, the "Winner Documents") within seven (7) days (fourteen [14] days if outside the United States) or the Prize may be forfeited ("Verification Date"). PRIZE (OR PORTION OF PRIZE) WILL NOT BE AWARDED UNLESS AND UNTIL A POTENTIAL WINNER CLAIMS THE PRIZE IN ACCORDANCE WITH THE PRIZE CLAIM PROCEDURE AS OUTLINED IN THIS RULE AND IN RULE 5, ABOVE. WITHOUT LIMITING THE FOREGOING, YOU ARE NOT A WINNER EVEN IF YOUR PRIME ACCOUNT INDICATES THAT YOU HAVE COMPLETED THE COLLECTION BY UNLOCKING ALL TEN (10) DIFFERENT TROPHIES AND SPONSOR/ADMINISTRATOR WILL NOT ACCEPT SCREEN-SHOTS OF COMPLETED COLLECTION/TEN (10) UNLOCKED TROPHIES IN LIEU OF THE PRIZE CLAIM PROCEDURE. Prize(s) will be provided to Winner(s) within twenty-eight (28) business days from receipt of contact information and completion of required Winner Documents.

If a Canadian or Mexican resident submits a Prize Claim, entrant will be required to correctly answer a mathematical skill-testing question without mechanical or other assistance of any kind, within a predetermined time limit, as a pre-condition to becoming a potential Prize winner.

8. Second Chance Drawing and Odds: If Prize is not claimed by the Prize Claim Date (for Germany, Closing Date) or if the Prize is claimed but Potential Prize Winner(s) did not timely return the Winner Documents by the Verification Date, or were determined not to be eligible, then, subject to any directions by a regulatory authority, Administrator will conduct a Second Chance Drawing to select an alternate Potential  prize winner as follows: All eligible entrants who inputted the highest number of different types of Codes [that is: collected the highest number of different types of Trophies] to their Prime Account as recorded therein without completing the Collection by unlocking all ten [10] different Trophies (i.e., excluding Potential Winners who failed to timely return the Winner Documents and were therefore disqualified or were disqualified for some other reason) will receive one (1) entry in the Second Chance Drawing. (The specific types of Codes inputted/Trophies unlocked will not affect the number of entries that an eligible entrant will receive in the Second Chance Drawing.) The Second Chance Drawing, if necessary, will take place at Administrator’s offices located at 2 Woodstock Meadows Ln, Woodstock, NY 12498 U.S.A. on August 20, 2025 at 11:30 a.m. ET/August 20, 2025 at 5:30 p.m. CEST/August 21, 2025 at 1:00 a.m. ACST. Odds of winning the Prize in the Second Chance Drawing (again, if necessary) depends on the number of eligible entrants who have inputted the most different types of Codes and thus unlocked the most different types of Trophies as recorded in their Prime Account without completing the Collection and unlocking all ten [10] different Trophies (i.e., excluding Potential Winners who failed to timely return the Winner Documents and were therefore disqualified or were disqualified for some other reason). For clarity, the Potential Winner in the Second Chance Drawing must complete and return the Winner Documents within the applicable time period in Rule 7 as a pre-condition to receive the Prize.

9. General Rules: By participating in the Promotion, entrants (if a Minor, their parent/legal guardian) agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator, subject to any directions from a regulatory authority. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. The Sponsor and its agencies (including Administrator) are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in any of the websites or the Promotion, including but not limited to, and to the fullest extent permitted by applicable law, the ability to access the Website, any error, malfunction or failure of any kind relative to inputting a Code to Prime Account or any message associated therewith (including an input Code failing to unlock a Trophy or, alternatively, to reveal a “You already unlocked this Trophy” message) or for any liability for damage to any computer system resulting from participation in, accessing, or downloading information on any websites or in connection with the Promotion. In the event of dispute, the authorized account holder of the email address used to create the Prime Account associated with inputting Codes will be deemed to be the entrant. Winner(s) may be required to show proof of being the authorized account holder of the email address associated with the applicable Prime Account. Proof of entering information does not constitute proof of delivery or receipt of such information. To the fullest extent permitted by applicable law, Sponsor and Administrator are not responsible for the failure of any Entry to be received or recorded by Sponsor/Administrator on account of technical problems or congestion on the internet or at any website. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Promotion; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion or to defraud Sponsor and/or Administrator may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participating in the Promotion, to the fullest extent allowed by applicable local law or public policy, entrants (if a Minor, their parent/legal guardian) agree that Sponsor, Administrator and their respective parents, subsidiaries, affiliated companies, agents, retailers, advertising and Promotion agencies and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents, as well as Google LLC, Shopify Inc., Meta Platforms, Inc., TikTok Inc., X Corp., and the owners of any other social media platforms will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property damages sustained due in whole or in part, directly or indirectly, from Entry creation (including but not limited to inputting Codes), the acceptance, possession, use or misuse of the prize or participation in the Promotion or participation in any Promotion or related activity. The preceding excludes any right or privilege that cannot be limited/modified/waived by a consumer pursuant to applicable local law or public policy. Despite the foregoing, nothing in these Official Rules limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void. By entering the Promotion, you (if a Minor, your parent/legal guardian) hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents. Should there be any inconsistency between the English and any other language versions of these Official Rules, the English language version shall prevail, govern and control in all respects, to the fullest extent allowed by applicable law.

10. UK, FRENCH, GERMAN, SOUTH AFRICAN AND AUSTRALIAN RESIDENTS: For residents of the United Kingdom, France, Germany, South Africa and Australia only:

  • Nothing in these Official Rules excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void ("Non-Excludable Guarantees") or any other liabilities which shall not be excluded under mandatory local law or public policy. Subject to the limitations in the preceding sentence, Sponsor excludes from these Official Rules all conditions, warranties and terms implied by statute, general law or custom; and
  • Notwithstanding anything to the contrary, nothing in these Official Rules shall exclude or limit a party’s liability for death or personal injury resulting from that party’s negligence, for fraud or fraudulent misrepresentation or for any other matter where liability may not as a matter of law be limited.

11. Force Majeure: Administrator and Sponsor reserve the right, subject to any directions by a regulatory authority, to postpone, cancel, suspend or otherwise modify the Game due to natural cataclysm, pandemic/epidemic, fraud, unauthorized human intervention, riot, strike, civil commotion, governmental action (including revocation of any government permit or authorization), materials shortage or any other occurrence beyond their reasonable control. In such case, to the extent feasible, Administrator and Sponsor will endeavor to conduct the Game and make the Prize available in a manner determined by Administrator/Sponsor in their sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action by Administrator/Sponsor will be posted on the Website. 

12. Disputes/Choice Of Law: 

For residents of the fifty (50) United States and the District of Columbia, Canada and Mexico: The Game and these Official Rules shall be governed by the law of the Commonwealth of Kentucky, U.S.A. (without regard to principles of choice of law/conflict of law) and, by participating in the Game, you (if a Minor, your parent/legal guardian) agree to the exclusive jurisdiction of the federal or state courts of the Commonwealth of Kentucky, U.S.A.

For residents of Québec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement. 

For residents of the United Kingdom: The Game and these Official Rules shall be governed by the law of England (without regard to principles of choice of law/conflict of law) and, by participating in the Game, you (if a Minor, your parent/legal guardian) agree to the exclusive jurisdiction of the courts of England and Wales.  

For residents of France: The Game and these Official Rules shall be governed by the law of France (without regard to principles of choice of law/conflict of law) and, by participating in the Game, you (if a Minor, your parent/legal guardian) agree to the exclusive jurisdiction of the courts of France.

For residents of Germany: The Game and these Official Rules shall be governed by the law of Germany (without regard to principles of choice of law/conflict of law) and, by participating in the Game, you (if a Minor, your parent/legal guardian) agree to the exclusive jurisdiction of the courts of Germany.  

For residents of Australia: The Game and these Official Rules shall be exclusively governed by and construed in accordance with the laws of the State or Territory in which you (if a Minor, your parent/legal guardian) reside.

For residents of South Africa: The Game and these Official Rules shall be governed by the law of South Africa (without regard to principles of choice of law/conflict of law) and, by participating in the Game, you (if a Minor, your parent/legal guardian) agree to the exclusive jurisdiction of the courts of South Africa.

To the fullest extent permitted by law, you (if a Minor, your parent/legal guardian) agree that: (a) any and all disputes, claims, or causes of action arising out of or connected with the Game, these Official Rules or the award of the Prize shall be resolved individually, without resort to any form of class action, and, to the fullest extent permitted by law, expressly waiving any right of forum non conveniens, change of venue or the like; (b) any and all claims, judgments, or awards, to the fullest extent permitted by law, shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Game, but in no event attorneys' fees; and (c) under no circumstances will you (if a Minor, and/or your parent/legal guardian) be permitted to obtain awards for, and you (if a Minor, your parent/legal guardian) hereby waive all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, as well as any right to injunctive or equitable relief, to the fullest extent permitted by law. 

13. Construction: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable by a court of competent jurisdiction, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

14. Data Protection/Privacy Policy: Your personal information may be collected for the purposes of conducting this Game. 

For residents of the United Kingdom, Germany and France only and to the extent applicable, the collection of your personal information will be subject to the privacy policy accessible at https://drinkprime.uk/pages/privacy-policy. Any personal information collected from you will be used by Sponsor and its designated agencies/representatives (the Data Processor) at the direction of Prime Hydration UK Limited/Prime Hydration, LLC (the "Data Controllers") at the addresses in Rule 1 above. To the extent applicable, personal information collected from participants will be used by Data Processor solely in connection with the Game and will not be disclosed to any third party or used for any other purpose except for conducting the Game, fulfilling prize(s) if and where applicable, and any other use mentioned within this clause. The lawful basis the Data Controllers rely on to process the Participants’ personal data is their need to perform their contract with the Participants (i.e. these Official Rules) and to comply with any legal obligation that they have in connection with the Promotion described herein. The declared prize winners’ name(s) and a reference to their winning Entry/Entries] (if any) will be made available on request in accordance with Rule 15 below. The personal information may be transferred outside the United Kingdom to the Data Processor and any subcontractors appointed, by the Data Controllers, to perform their obligations under these Official Rules , including outside the European Economic Area ("EEA"), in countries such as the United States.

Prime Hydration, LLC and its designated agencies/representatives  have joined the EU-US Data Privacy Framework which, according to the European Commission’s adequacy decision adopted on July 23, 2023, offers an adequate level of protection – comparable to that of the European Union –for personal data transferred from the EEA to American companies under this framework. 

The subcontractors appointed to perform the obligations of the Data Controllers under these Official Rules have entered into data processing agreement with Prime Hydration UK Limited to allow the transfer of the Participants’ personal data outside the EEA. The preceding also applies to Congo Brands Australia Pty. Ltd. with respect to Australia.

The duration of the retention of the information is until January 1, 2026. Participants have a right to access, correct and have their personal data deleted from Sponsor’s database and to set the consequences of their death on their personal data. They can also oppose the processing of their personal data. Participants can exercise these rights by sending a written request to Prime Hydration UK Limited/Prime Hydration, LLC at the addresses in Rule 1 above.

Personal information includes name, e-mail address, and mailing address and will be used as set out in these Official Rules including: (a) to preliminarily confirm eligibility prior to Entry/Entries, (b) to contact potential winner(s) for verification purposes, and (c) to deliver the prize to verified winner(s).

For France: Participants have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés, CNIL: www.cnil.fr.

For residents of Canada, Mexico, Australia and South Africa, your personal information will be transferred to the United States which may not provide as robust protection for your personal information as your home country. Accordingly, for Australian entrants, by entering the Promotion you (if a Minor, your parent/legal guardian) consent to subclause 8.1 of the Australian Privacy Principles not applying to the disclosure of your personal information. This section does not limit any other consent(s) that an entrant may provide the Sponsor in relation to the collection, use and/or disclosure of their personal information.

15. Winners List: For name of Winner(s), send an email to winnerslist@probabilityworks.com: with: Prime Curate Your Legacy Promotion Winner as the subject line. Requests must be received by September 1, 2025 at 9:00 a.m. ET/September 1, 2025 at 3:00 p.m. CEST/September 1, 2025 at 10:30 p.m. ACST. Winners List will be sent after the Prize has been awarded.

For South Australian residents only: To the extent applicable, except where a South Australian winner has requested their name and postcode not to be published, the first initial, surname and postcode of South Australian winner[s] will be published on the Website within thirty (30) days of the Verification Date or Second Chance Drawing date (as the case may be).
